PazPort Terms of Service

These Terms set the rules for using the PazPort app, website, and related services.

These Terms are an agreement between you and PazPort ("PazPort," "we," "our," or "us") for the PazPort app, pazport.app, and related services that link to them (the "Services"). Our Privacy Policy explains how we handle information; it is a separate notice and is not part of these Terms.

1. Acceptance and Eligibility

By selecting an action that states you agree, creating an account, or accessing or using the Services after these Terms are made available, you agree to them. If you do not agree, do not use the Services.

You must be at least 13. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you. You may not use the Services if law prohibits it.

2. Optional Accounts

Core PazPort features are available without an account. An account may let you restore selected preferences, profile choices, and eligible crossing history. You are responsible for access to your email or sign-in provider and for activity under your account.

Provide accurate sign-in information, do not impersonate another person, and tell us promptly about unauthorized access. PazPort may limit active sessions for account security. You may delete your account in the App.

3. What PazPort Provides

PazPort provides border wait information, forecasts, recommendations, optional crossing tracking, widgets, cameras, guides, and related planning tools. Features may vary by device, location, build, data availability, or permission state.

Waits, forecasts, routes, conditions, availability, and recommendations are estimates. They may be delayed, incomplete, or wrong. Border agencies and other official authorities make all entry, document, inspection, fee, and travel decisions.

4. Official Information and Advice

PazPort is independent and is not a government agency or endorsed by one. The Services provide general information, not legal, immigration, tax, medical, or other professional advice. Always check current official sources and seek a qualified professional when your situation requires one.

5. Safety

PazPort is not an emergency or safety-critical service. Do not use it as your only source for urgent conditions, and do not interact with the App while driving. Follow signs, officers, laws, and road conditions.

6. Optional Features and Permissions

Location, background activity, notifications, analytics, and similar features remain optional unless clearly stated for a feature you choose. Device permission prompts and in-App controls are separate from these Terms. You may change them later, though some features may stop working.

7. Contributions and Feedback

You may submit wait reports, lane feedback, corrections, support messages, or suggestions. Submit only information you have the right to provide. Do not submit false, misleading, unlawful, harmful, or sensitive personal information about another person.

You keep any rights you hold in your submission. You grant PazPort a worldwide, non-exclusive, royalty-free license to host, process, reproduce, adapt, and display it only as reasonably needed to operate, secure, support, and improve the Services. Suggestions may be used without payment or confidentiality obligations.

8. Guides and Document Tools

Guides, checklists, and document tools are for general clerical help. You are responsible for choosing the correct process, reviewing every answer, using the current official form and instructions, obtaining required signatures or advice, and submitting materials to the correct authority.

PazPort does not file, approve, certify, notarize, or guarantee a document or application. Do not use the Services to make a false statement, forge a document, evade a requirement, or act for someone else without authority.

9. Third-Party Services

The Services may show, open, or rely on government sites, maps, app stores, live-camera or media providers, sign-in providers, and other third parties. We do not control their content, availability, security, privacy, or terms. Your use of them is subject to their rules.

10. License and Acceptable Use

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services as these Terms and applicable platform rules allow.

You may not:

  • copy, sell, sublicense, or commercially exploit the Services;
  • reverse engineer or bypass technical or security controls, except where law permits;
  • scrape, automate, or extract data at scale without written permission;
  • introduce harmful code or interfere with the Services or other users;
  • misrepresent PazPort data as official or guaranteed; or
  • use the Services to violate law or another person's rights.

11. Changes, Suspension, and Termination

We may add, change, suspend, or discontinue features. We may also update these Terms. For material changes, we will provide reasonable notice and may require renewed acceptance before continued use. Other changes become effective when posted with a new date.

We may restrict an account, submission, or access when reasonably needed for security, legal compliance, service integrity, or a violation of these Terms. You may stop using the Services at any time. Sections that by their nature should continue will survive.

12. Intellectual Property

PazPort and its licensors own the Services and PazPort branding, software, design, and original content. Government and third-party materials remain owned by their respective owners. Their presence does not imply endorsement.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." PAZPORT DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING ACCURACY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted or secure operation, current or complete data, a particular wait or travel result, or acceptance of any guide, form, or document. Some laws do not allow certain disclaimers, so part of this section may not apply to you.

14. Liability and Indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAZPORT AND ITS AFFILIATES, PERSONNEL, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAZPORT'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID PAZPORT FOR THE SERVICES IN THE PRIOR 12 MONTHS OR USD $50.

To the extent permitted by law, you will indemnify PazPort from third-party claims and reasonable costs caused by your unlawful use, your submissions, or your material violation of these Terms. Non-waivable consumer rights remain unaffected.

15. Law and Electronic Communications

These Terms are governed by Texas law, without regard to conflict rules and without limiting non-waivable rights where you live. Any dispute must be brought in a state or federal court in Texas that has lawful jurisdiction.

You agree to receive these Terms, the Privacy Policy, and account, security, and service notices electronically. This does not consent to marketing messages. Electronic acceptance has the effect allowed by applicable law.

16. Mobile Store Terms

If you downloaded the App from Apple's App Store:

  • these Terms are between you and PazPort, not Apple, and PazPort is solely responsible for the App and its content;
  • your license is limited to Apple-branded products you own or control, as allowed by Apple's usage rules, including permitted Family Sharing or volume use;
  • PazPort is responsible for maintenance and support; Apple has no duty to provide either;
  • if the App fails to conform to an applicable warranty, you may notify Apple for a refund of any purchase price; Apple has no other warranty obligation to the extent law permits;
  • PazPort, not Apple, is responsible for product, legal, regulatory, consumer-protection, and privacy claims involving the App;
  • PazPort, not Apple, is responsible for investigating and resolving third-party intellectual-property claims involving the App;
  • you must comply with applicable App Store and third-party terms; and
  • Apple and its subsidiaries are third-party beneficiaries of these Terms.

You represent that you are not in a U.S.-embargoed location or on a U.S. government restricted-party list. If you downloaded the App from Google Play, these Terms are between you and PazPort, and Google Play's terms also apply.

17. General and Contact

These Terms are the entire agreement about the Services. If a provision is unenforceable, the rest remains effective. A failure to enforce a provision is not a waiver. You may not assign these Terms; PazPort may assign them as part of a reorganization or transfer of the Services.
